The short version

This summary is here to help you read the terms. The full terms below are what count.

1. Who we are and accepting these terms

These terms are an agreement between you and [TEAM TO CONFIRM: the legal name of the company, its registered address and its company number] (“Brand Atlas”, “we”, “us”). By creating an account or using Brand Atlas, you agree to these terms. If you agree on behalf of a company or other organisation, you confirm you are allowed to, and these terms bind that organisation. Brand Atlas is for business use only. You must be at least 18 to create an account.

2. Accounts, owners, team members and viewers

The account owner. Every account has one owner. The owner chooses the plan, pays for it, and decides who else can use the brands on the account. The owner is responsible for what everyone they invite does in Brand Atlas. Team members. The owner can give team seats to other people. Team members use Brand Atlas under the owner’s agreement with us and must follow these terms and the Acceptable Use Policy. Changing owner. An owner can hand a brand to someone else by their email address. Nothing changes until that person accepts. From then on, the brand runs on the new owner’s plan and they are responsible for it. Content belongs to the brand, so what a team member added stays with the brand when their seat is removed. Viewers. People who open a share link you send (an Atlas Link, or a link to a file or folder) are not parties to these terms. They are bound by the Acceptable Use Policy, and you are responsible for whom you share with. Keeping your account safe. Keep your sign-in details to yourself, and tell us straight away if you think someone else has used them.

3. Your content and our licence to host it

You own your content. Everything you put into Brand Atlas (pages, logos, colours, fonts, files, comments and chats) stays yours. What you let us do with it. You give us a non-exclusive, worldwide, royalty-free permission to store, copy, display and process your content only as needed to run Brand Atlas for you, including showing it to the people you share it with and running the AI features you use. This permission ends when your content is erased. Your rights to upload. Brand material is often licensed from someone else, especially fonts, photos and illustrations. You confirm that you have the rights to everything you upload and share through Brand Atlas. Reports about content. If someone tells us your content breaks their rights or the law, we may look at it, and if needed remove it or restrict access, as set out in the Acceptable Use Policy.

4. Acceptable use

You and everyone on your account must follow the Acceptable Use Policy.

5. AI features and connected AI apps

Brand Atlas includes AI features, and lets you connect your own AI apps to your brand. How these work, and what we do and do not do with your content, is set out in the AI terms, which form part of these terms.

6. Other services you connect

Some features rely on services you choose to connect, such as your own OpenAI or Google Gemini key for Henry, or your own AI app through the Atlas MCP. Your use of those services is under your agreement with their provider. We are not responsible for what they do with data you choose to send them.

7. Plans, the trial, renewal and payment

The trial. A new account starts with a 14-day trial. No card is needed to start it. When the trial ends without a paid plan, the account moves to the free Scout plan. Nothing is deleted when that happens: content in areas your plan no longer includes is kept, read-only. Paying during the trial. If you choose a paid plan during your trial, we take your card details then, but the first charge is made when your trial ends. We remind you in the app before that first charge. Where we run an offer (such as a free third month for subscribing early on a monthly plan), the offer’s conditions are shown before you pay. Renewal. Paid plans renew automatically for the same period (monthly or yearly) until cancelled. We charge your card at the start of each period without asking again. Prices. Plan prices are shown in the app before you buy. We give you at least 30 days’ notice of a price increase, and it applies from your next renewal after the notice ends. Payments. Our payment provider, Stripe, processes payments. Prices are exclusive of taxes unless shown otherwise. [TEAM TO CONFIRM: how sales tax and VAT are charged.] Failed payments. If a payment fails and is not put right, the account moves to the free Scout plan until it is. Refunds. Fees already paid are not refundable, and we do not give credit for part of a period, except where the law requires it. [TEAM TO CONFIRM: the refund policy.] Block packs. One-off purchases, such as block packs, are charged once when you buy them.

8. Cancelling and ending this agreement

Cancelling a plan. You can cancel a paid plan at any time from your billing settings. You keep the plan until the end of the period you have paid for, and then the account moves to the free Scout plan. Deleting a brand or your account. You can delete a brand, or your whole account, from Settings. A paid plan on it ends straight away, and the brand is closed at once. Your data is then handled as set out in section 9. When we can end it. We may suspend or close an account that seriously or repeatedly breaks these terms or the Acceptable Use Policy, or where the law requires it. Where it is reasonable, we warn you first and give you a chance to put it right.

9. Your data when you leave

Export. While your account is open you can download your files and export your whole brand as one ATLAS.md file. After you delete. When you delete a brand or your account, we keep it for 30 days so it can be restored if you change your mind. After that we erase it from our live systems. Copies in our backups are removed as those backups expire, within a further 30 days. [TEAM TO CONFIRM: the export window and deletion timings we promise.] What we keep. We keep only what the law requires or what is needed to show the deletion happened, such as invoices and a record that the erasure took place. The Privacy Policy sets out the details.

10. Our intellectual property and your feedback

Brand Atlas itself (the software, design, blocks, templates and our own content) belongs to us and our licensors. These terms give you the right to use it while your account is open, and no other rights. If you send us ideas or feedback, we may use them freely, without owing you anything.

11. Confidentiality

We treat your content as confidential. We only share it with the people you share it with, with the providers who help us run Brand Atlas (listed on the Subprocessors page), or where the law requires us to.

12. Personal data

The Privacy Policy explains how we handle personal data about you. When your content includes personal data about other people, we handle it on your behalf under the Data Processing Agreement, which forms part of these terms.

13. What we promise, and what we do not

We will run Brand Atlas with reasonable skill and care. Apart from that, and to the extent the law allows, Brand Atlas is provided as it is, and we do not promise it will always be available or free from errors. AI output in particular can be wrong; see the AI terms.

14. Limits on our liability

Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud. Subject to that:
  • We are not liable for indirect or consequential loss, or for loss of profit, revenue, business or goodwill.
  • Our total liability to you under or in connection with these terms is limited to the fees you paid us in the 12 months before the claim arose.

15. Your responsibility to us

If someone brings a claim against us because of content you uploaded or shared, or because you or your team broke these terms, you will cover our reasonable losses and costs from that claim.

16. Changes to Brand Atlas and to these terms

Brand Atlas changes as we improve it. We may add, change or remove features. We may update these terms. If a change matters, we will tell you by email or in the app at least 30 days before it applies. If you do not agree, you can cancel before it applies. Each version of these terms is kept, with a list of changes at the end of this page.

17. General

  • You may not transfer this agreement without our written agreement. We may transfer it as part of a sale or reorganisation of our business, and will tell you if we do.
  • Neither of us is liable for delays caused by events outside our reasonable control.
  • We send notices to the account owner’s email address. You can send notices to [TEAM TO CONFIRM: legal contact email].
  • These terms, with the documents they link to, are the whole agreement between us about Brand Atlas.
  • If part of these terms cannot be enforced, the rest still applies.

18. Governing law

[TEAM TO CONFIRM: the governing law and the courts that hear disputes. Drafted on the assumption of England and Wales.] These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
